Broward County has now confirmed for me that they own the security cameras, despite telling me that they are in possession of no video taken on the date and time in question. Then they added in this gem:
“Additionally, even if they did exist, we have been informed by the TSA that this particular information (security camera recordings) is … SSI.”
Broward County has some explaining to do. Do these cameras not actually record? Do videos exist, but they are denying their existance because of their (false) belief that they constitute SSI? (SSI is a designation internal to the TSA; a third party’s records cannot be SSI.) Have the videos now been disgarded?
…and I have some research to do: If a third party destroys evidence after being notified of the necessity to preserve evidence, what is their liability?
I’m rooting for you all the way. I want to see this dam TSA get some heat for a change. It is MORE than obvious that they are not truthful and I have a difficult time knowing people are aware of this and do NOTHING about. Has America become that dumbed down? Good for you and thank you for what you are doing.
Jon – nice work. So far they haven’t rejected your last appeal on the original court case, but I’m not hopeful.
What is next step in Discovery? Do you contact the Broward County Executive or even a state Attorney General to help you out?
I’m still trying to persuade Broward to confirm the existance of and release the video. If that continues to go nowhere, I’ll treat it as a denied FOIA request, and submit a FOIA appeal. This isn’t yet “discovery” because the case isn’t yet filed — I have to wait until the end of February for my FTCA claim to expire before I can file.
What I fear happened is that Broward mistakenly or intentionally told me that the videos don’t exist, and at this point, they have been discarded. If that is the case, Broward will be joining the TSA as a co-defendant when I file on 2/29. But luckily, I still have the audio. 0:-)
Obstruction of evidence is obstruction of justice. TSA is a fraud on the entire system. They will hide behind Broward County as long as they can get away with it.
